COMPETITION LAW
In matters of competition law, at P&B Consultorías we provide economic advice on the various needs of our clients.
Whether in contentious or non-contentious cases, damages claims and regulatory recommendation procedures, our services include: (i) the development of strategies to address each case or investigation, (ii) technical notes, and (iii) the preparation of economic reports.
Our work has been recognized by our clients’ legal advisors as a major contribution in the development of each case. Likewise, we have been able to sustain relevant structures that make up our clients’ competitive position, all of this within the boundaries of competition law.
We also provide advice on compliance, ensuring that the strategic decisions of our clients −from an economic perspective− lay within the framework of competition law.
COMPETITIVE STRATEGY
As far as strategy is concerned, we work alongside our clients’ internal teams to help them optimize their decision-making process.
Our experience in applied microeconomics allows us to understand each industry’s market equilibria and to convey their mechanisms to our clients. We have achieved our clients are able to; (i) internalize the relationship between variables that they previously analyzed in isolation, (ii) manage to distinguish between short-term and structural phenomena, and (iii) rationalize the strategies of other industry players in order to anticipate their actions when possible.
We also advise our clients in their search for internal synergies and restructuring. We provide them as well with market forecast for their medium-term decisions.
ECONOMIC EXPERTISE IN ARBITRATION
At P&B Consultorías we provide an economic rationale and with it we analyze the available information in arbitration disputes.
Whether in cost overrun disputes, transfer pricing, or financial disputes, we prepare in-depth analysis in which we examine documents of various kinds and large volumes of data −when needed−, in order to provide our clients with an argument that can be sustained in the arbitration These services will usually take the form of reports, technical notes, and expert presentations.
INTERNATIONAL TRADE DISPUTES AND PRICE DISTORTIONS
In the face of complaints of economic distortions related to international trade, we accompany our clients and their legal advisors throughout the whole process.
We analyze all the conditions that must be met for the authorities to impose antidumping measures, safeguards or countervailing measures. We provide technical notes as inputs for the legal teams, prepare reports, and make presentations in the instances required.
INVESTMENT FUNDS DEVELOPMENT AND MANAGEMENT
Our analysis and knowledge of several markets has allowed us to detect investment opportunities. This has been materialized in joint ventures with Bci Asset Management, since 2010, and Credicorp Capital Asset Management since 2013, with whom we have developed investment funds in real assets in Chile.
